Brownfields Redevelopment/Georgia

Recent Brownfields legislation in the State of Georgia has provided an opportunity to purchase and redevelop existing contaminated properties with a true limitation of liability for the new owner. This legislation (House Bill 1406) is termed the Georgia Hazardous Site Reuse and Redevelopment Act, as amended in 2002. .  This legislation provides the new owner with a limitation of liability, for existing environmental impacts, from both the State and third party lawsuits.  In effect, the new owner will not be required to certify compliance with the risk reduction standards for groundwater, perform corrective action or be liable for previous releases to groundwater. However, this limitation of liability is based on the State’s concurrence with either a limited “Certification of Compliance” for soils and source materials or the approval of a Corrective Action Plan.

This new program requires a firm that understands these issues and can develop appropriate strategies that result in clear communication with regulatory agencies and preparation of reports that meet the criteria of the State.
