Brownfields legislation in the State of Georgia has provided an opportunity for developers to purchase and redevelop existing contaminated properties with a true limitation of liability for the new owner. In Georgia, the program is called the Hazardous Site Reuse and Redevelopment Act, as amended in 2002 (HSRRA). This program provides the new owner with a limitation of liability, for existing environmental impacts, from both the State and third party lawsuits. To be successful, developers need a firm that understands these issues and can develop appropriate strategies that result in clear communication with regulatory agencies and preparation of reports that meet the criteria of the State.
